Terms & Conditions — Hunter MTB Coaching
1. Company Definition
In this document, "The Company" refers to Hunter MTB Coaching, a sole trader mountain bike coaching business operating in New Zealand. Hunter MTB Coaching is independently owned and operated with no employees and provides mountain bike coaching services to individuals and groups.
By booking a coaching session with The Company, you acknowledge and agree to these Terms & Conditions.
Participation Requirements & Safety
2. Rider Responsibilities
By participating in any mountain bike coaching session, I confirm that:
I am in good health and physically fit to participate.
I do not have any medical conditions, injuries, or disabilities that may affect my ability to ride safely.
I will inform the coach of any medical conditions or injuries before riding.
My mountain bike and protective gear (helmet, gloves, knee/elbow pads) are in safe working order and suitable for the terrain.
I understand that The Company will take all reasonably practicable steps under the Health and Safety at Work Act 2015 to ensure my safety. However, I acknowledge that I am ultimately responsible for assessing and managing my own risk during participation.
3. Adventure Activity Registration Compliance
The Company will comply with the Health and Safety at Work (Adventure Activities) Regulations 2016 and, if required, will register with WorkSafe New Zealand as an adventure activity operator. This includes undergoing safety audits to meet legal standards.
4. Parental/Guardian Consent (For Riders Under 18)
Riders under 18 years old must have a parent or legal guardian sign a consent and liability waiver before participating.
The guardian is responsible for ensuring the rider is capable of participating safely.
Booking & Payment Policy
5. Booking & Payment
All coaching sessions must be booked in advance through Acuity Scheduling.
Full payment is required at the time of booking unless a prior arrangement has been made.
Pricing for private and group sessions may vary — full details are available at the time of booking.
6. Cancellations & Refunds
Private Lessons & Group Lessons:
Cancellations made more than 48 hours before the scheduled session are eligible for a full refund or reschedule.
Cancellations made within 48 hours of the session are non-refundable, except in exceptional circumstances (assessed at the sole discretion of The Company).
The Company adheres to the Fair Trading Act 1986 to ensure cancellation terms are fair and transparent.
Acknowledgement of Risk & Liability Waiver
7. Risk Acknowledgement
Participating in any adventure activity involves an element of risk. By taking part in Hunter MTB Coaching's lessons, clinics, or coaching sessions, you acknowledge that mountain biking carries inherent risks, primarily related to falls and collisions with the ground, trees, or other obstacles.
These incidents may result in:
Minor injuries – such as cuts, bruises, abrasions, or sprains
Moderate injuries – including broken bones, dislocations, or concussions
Serious injuries or worse – including spinal, internal, or head trauma
Hunter MTB Coaching has robust safety management procedures in place to minimize these risks, but your cooperation is essential. Please:
Follow all instructions carefully
Communicate any concerns or uncertainties
Ride within your ability at all times

8. Liability Disclaimer & Indemnity
To the fullest extent allowed under New Zealand law, I agree to:
Release and indemnify The Company from any claims, damages, or losses arising from participation — except in the case of proven negligence or misconduct.
Accept that The Company is not liable for injury, death, or property loss unless legally proven negligent.
Voluntarily assume all risks associated with mountain biking.
This waiver does not override rights under:
The Consumer Guarantees Act 1993 (ensuring services are delivered with reasonable care and skill)
The Health and Safety at Work Act 2015 (ensuring safety standards are met)
9. Personal Insurance Responsibility
I understand that The Company does not provide personal accident, medical, or income protection insurance.
It is my responsibility to arrange my own cover if I wish to be insured.
10. Equipment Responsibility
I am responsible for ensuring that my bike and gear are safe and functional before each session.
I will notify the coach immediately of any equipment issues.
If using rental gear, I acknowledge that I have inspected it and raised any concerns prior to use.
Media Consent & Emergency Treatment
11. Media Consent
By participating in sessions with The Company, I give permission for Hunter MTB Coaching to photograph or record me (and/or my child, if applicable) during coaching sessions, events, or related activities. I understand and agree that:
The Company may use these Images for marketing, education, and promotional purposes in print and digital media (e.g. social media, websites, ads, brochures).
The Company may edit, crop, alter, or reproduce these Images for current or future use.
I will not receive payment or compensation for the use of these Images.
I waive any rights to review or approve Images before publication.
The Company will manage any media in accordance with the Privacy Act 2020, ensuring responsible handling of personal data.
12. Emergency Treatment Authorisation
In the event of an accident or emergency:
I authorise The Company to administer first aid and/or seek medical treatment if required.
I accept full responsibility for any medical costs incurred as a result of my participation.
